Terms of Use (End User Licence Agreement)

These terms apply to the Android app Folio Engineering Calculator (the "app"). They're published by Obsidian Dynamics Limited, a company registered in England and Wales (company number 16663833), Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset BH16 6FA ("we", "us"). By installing or using an app, you agree to these terms.

1. Licence

We give you a personal, non-exclusive, non-transferable licence to use each app on Android devices you own or control, under these terms and the Google Play Terms of Service. You may not copy, modify, reverse-engineer, resell or redistribute the apps, except where the law allows it. We, or our licensors, keep all rights in the apps. Open-source components are licensed under their own terms, which are listed in each app.

2. Your data

The apps store your data on your device and don't send it to us. You're responsible for your device and for backing up your data, including keeping exported files and backup files safe. Our privacy policy is at obsidiandynamics.co.uk/privacy.

3. Trial, free features and one-off purchases

• Folio Engineering Calculator is free to use. Pro is an optional one-off in-app purchase that adds branded reports and batch reports. Accuracy and safety information is never limited to Pro.
• One-off purchases aren't subscriptions and don't renew. A purchase is linked to the Google account you used, and you can restore it on another device signed in to that account.
• While the apps are in testing, no payment is taken. Paid features may show "Not available yet — no payment taken."
• Prices are shown in Google Play before you buy. Google Play takes payment and handles any tax due on the sale.

4. Refunds

Purchases are made through Google Play, so refunds are handled by Google Play under its refund policies: see support.google.com/googleplay. If you have a problem with a purchase, you can also email apps@obsidiandynamics.co.uk and we'll help where we can. If you're a consumer, nothing in these terms affects your legal rights, including your rights under the Consumer Rights Act 2015 for digital content that's faulty or not as described.

5. Calculation results (Folio Engineering Calculator)

Calculation results are a guide. Verify critical designs. Folio Engineering Calculator carries out calculations based on the inputs, methods and assumptions shown in the app. It doesn't give pass or fail verdicts, and it doesn't replace engineering judgement, the relevant standards, manufacturers' data, or review by a competent person. Check any result that affects safety, structural integrity, pressure equipment, lifting, inspection acceptance or compliance independently before you rely on it. Within the limits of section 6, you're responsible for how you use the results.

6. Our liability

We supply the apps with reasonable care and skill. Beyond that, and to the extent the law allows, they're provided "as is". Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law. Subject to that, we aren't liable for business losses (such as loss of profit, revenue, contracts or data) or for loss that wasn't reasonably foreseeable. Our total liability to you for any app is limited to the amount you paid for that app's purchase, or £50 if you paid nothing, whichever is higher.

7. Updates and changes

We may update the apps to fix problems, keep them working or improve them. We may change these terms. If a change matters to you, we'll show it in the app or on this page before it takes effect. If you keep using the app after that, you accept the new terms. We won't take away a one-off purchase you've already paid for, except where a feature has to be removed for legal or security reasons.

8. Ending the licence

You can stop using an app at any time by uninstalling it. We can end your licence if you seriously break these terms. If that happens, you must stop using and delete the app.

9. Law

These terms are governed by the law of England and Wales. Consumers living elsewhere in the UK can bring a claim in their local courts and keep any mandatory protections of their local law.
